The law states specificly through the building code, and the city fire code, adaped by the city of Steamboat
Springs, as mandated by the state and federal government, that certain minimum requirements shall be required of a rental unit, weather the person renting said unit is competent or not, shall meet these minimum requirements.

That is the law, somebody broke this law.
A man parished as a result of this violation of the law.
Now even in the gilded city of Steamboat Springs, with the housing, and real estate combine that it is, the law is still the law.
Just like Wall's trial, it may have to be tried in another venue.

There are many, many defenceable contingincies here, but a death has occurred no less, the DA, may not have a choice, but to procecute…………

Most other communities and/or HOAs just pick up the signs, some trash them, others have you come down to the police dept. and pick them up.
I personally favor out lawing real estate signs all together, through out the city, nothing but blight, there is not a attractive one out there, and soon there could be thousands. When the public wants to know whats for sale, they would have to contact a Realtor………

Yes there are limitations to an action, wrongful death for example, but starts at the time of death, discovery is not possible until after death therefore, commencement.
There are very complicated exceptions involving fraud, deceit, and criminality, that may extend these limitations.
We are talking a death here, not a roofing problem, the people, and enities involved can always hope the family does wait past the I believe two years, but I doubt a good attorney firm would make that error.
They may go to a criminal action first, prove that then go on to a civil action for the money, we won't be able to try this here, but make no mistake, sombody is looking at a trial somewhere.

id, very interesting, was Luna loaded to??? I don't think it matters one iotta if David or his dog were intoxicated, not one bit. A man should be able to come home with his dog be all crap faced, start to cook a meal and pass out with out dying in his own abode.
I don't think the family will have a problem finding a attorney firm to take this case on a contingency basis.
There are plenty of deep pockets complicent here, just start with the Realtors and the Realtor firms who passed this property off as a legal rental unit, I would want in my file a complete and comprehensive document totaly exculpateing me and my firm firm from any liability, and I am not so sure you can be exculpated from a criminal act by contracting yourself out.
If you are a Realtor, Broker owner, appraiser, property inspector, owner, past owner, title company, with a file on this property since 1974, have a nice day…………..

bwatt, get down to the library and read up on “liability” how it is defined, interpeted and applied by the law.
Read up on product liability.
Go back and read my other posts in the articles on Davids death, there is no point in me repeating myself.
Do a little law research and get back to us.
David did not kill himself, his death could very well be tried as a negligent homicide first. There are plenty of people and enities as potential defendants, that could have criminal and or civil liability.
I hope you are not one of them………
