Second man involved in fuel theft sentenced to 4 months in Routt County Jail
One of the two men involved in stealing 6,000 gallons of gas from Pilot Flying J station was sentenced to four months in jail on Tuesday.
David Caboverde, 22, was arrested Dec. 5 with another man, Onsel Perez Palacio, and was charged with theft, third-degree burglary and conspiracy to commit. Caboverde will be detained by U.S. Immigration and Customs Enforcement after his sentence is served.
According to the arrest affidavit, Steamboat Springs Police Detective Christian Barnett observed a box truck that began fueling at 6:39 p.m. and departed the gas station at 7:47 p.m. on Dec. 5.
When asked why the truck took an hour to fuel, the driver, Perez Palacio, stated that he was paying with gift cards and it took 45 minutes for the cards to activate, according to the affidavit.
Officers arrested Perez Palacio and Caboverde after they “determined there was belief and probable cause,” according to the affidavit.
Caboverde and Perez Palacio have remained in custody at the Routt County Jail since their arrests.
Perez Palacio was sentenced to four months in jail and $6,556 in restitution costs on Friday after pleading guilty to an amended charge of theft.
Following Perez Palacio’s sentencing, Caboverde appeared in court for a similar sentencing of four months in jail and $6,556 in restitution costs but pleaded guilty to one count of criminal mischief.
According to Routt County Judge Erin Wilson, Caboverde and Perez Palacio will share the total restitution cost of $6,556.
As of the day of the sentencing, Caboverde had served 90 days of his 120-day sentence, leaving 30 days remaining in his sentence.
According to Public Defender Randy Salky, ICE has placed a detainer on Caboverde and he will be “deported as soon as he finishes his sentence.”
The third man accused of fuel theft in Routt County, Victoriano Cayetano Leon, is scheduled to appear in court March 19. He will appear virtually from the ICE detainment facility in Aurora.
In another fuel theft case in Moffat County, Geomar Gomez-Hernandez, who was arrested Dec. 26 after fleeing from police following an alleged fuel theft at a Craig gas station, is scheduled for a court appearance April 1.
